Terms of trade

1. Quotations

Quotations are valid for seven days unless stated otherwise, and are subject to the goods remaining unsold. Prices are quoted exclusive of freight, insurance, duties and local taxes unless the quotation says otherwise.

2. Description of goods

Melee and small goods are sold by sortment — a sieve range, a colour band and a clarity band — assessed on the parcel as a whole under 10× magnification, which is standard practice in the trade at these sizes. Individual stones within an agreed band will vary within that band; that is what a band means.

Stones of 0.30 ct and above, where sold with an independent laboratory report, are described by that report. The report, not our description, governs.

3. Inspection and claims

Inspect goods on arrival. If the sortment, weight or piece count does not match the packet, notify us in writing within seven days of delivery, with photographs. We will replace the parcel or refund it, at your election. Where the discrepancy is ours, we pay freight both ways.

After seven days, goods are deemed accepted as described. Claims about characteristics within an agreed band are not accepted, and claims relating to damage caused during setting are assessed individually — we will give an honest opinion whether or not it favours us.

4. Title and risk

Risk passes on delivery to your nominated address or your nominated carrier. Title in the goods remains with Nandanvan Gems until payment has been received in full and cleared.

5. Payment

First orders are payable in advance by bank transfer. Credit terms, where agreed in writing, are strictly net of the stated period. We do not accept cash settlement above statutory limits under any circumstances, and we will decline rather than restructure a transaction to avoid those limits.

6. Warranty of origin

Every invoice we issue carries the industry System of Warranties statement: the diamonds supplied have been purchased from legitimate sources not involved in funding conflict, in compliance with United Nations resolutions, and we hereby guarantee that they are conflict free and based on personal knowledge and written guarantees provided by the supplier of these diamonds. All rough entering our floor arrives under Kimberley Process certification.

We supply natural diamonds only. We do not manufacture, stock or trade laboratory-grown diamonds.

7. Delivery dates

Lead times quoted are estimates made in good faith. Where a date is critical, tell us before confirming the order so we can either commit to it or decline it. We would rather refuse a deadline than miss one.

8. Cancellation

Orders for goods from live stock may be cancelled before dispatch. Orders for goods cut to order or calibrated to your specification cannot be cancelled once cutting has begun, because the goods have been made to a size only you have asked for.

9. Confidentiality

CAD files, designs and specifications you send us are treated as confidential, used only to quote and produce your order, and are not shown to other customers or used in our own marketing without your written permission.

10. Governing law

These terms are governed by the laws of India, and the courts at Surat, Gujarat have exclusive jurisdiction.
